Welcome to Kaan. This Privacy Policy explains how Desert AI Company ("we", "our", or "us"), based in the Kingdom of Saudi Arabia, collects, uses, discloses, and safeguards your personal information when you use the Kaan mobile application ("App").

By using the App, you agree to the collection and use of information in accordance with this Privacy Policy. If you do not agree with the terms of this policy, please do not use the App.

We collect the following types of personal information when you register and use the Kaan App:

2.2 Location Data

We collect your device's location data to provide location-based services such as displaying nearby deals, merchants, and offers relevant to your area. Location data is only collected when the App is in use and with your explicit permission.

2.3 Payment Information

Kaan does not directly collect, store, or process your payment card details. All payment transactions are securely handled by our trusted payment gateway provider, PayMob. By making a payment through the App, you are subject to PayMob's Terms and Conditions and Privacy Policy, available at: https://paymob.sa/terms-conditions/

2.4 Usage Data

We may automatically collect information about how you interact with the App, including pages visited, features used, time and date of access, and device information (such as device type, operating system, and unique device identifiers).

2.5 Cookies & Tracking Technologies

The App may use analytics SDKs, cookies, and similar tracking technologies to support its functionality and improve performance. Through these technologies, we may collect:

  • Device ID and IP address
  • Session information and app interaction data (e.g., screens visited, buttons tapped)
  • Crash reports and performance diagnostics
  • Language and regional settings

The legal basis for this processing is our legitimate interest in keeping the App secure and improving user experience (Art. 6(4) PDPL). You may limit certain tracking through your device's privacy settings.

3. How We Use Your Information

Once you opt out, we will add your contact details to a suppression list to ensure you do not receive further promotional communications. Note that you may still receive essential service-related messages (e.g., order confirmations, security alerts).

4. Legal Basis for Processing Personal Data

In accordance with the Personal Data Protection Law (PDPL) of the Kingdom of Saudi Arabia, we process your personal data based on the following legal grounds:

  • Location data: Consent — Art. 5(1) PDPL
  • Payment processing (via PayMob): Contractual necessity — Art. 6(2) PDPL

5. Data Sharing and Disclosure

We do not sell, trade, or rent your personal information to third parties. We may share your information in the following limited circumstances:

5.1 Service Providers

We may share your data with trusted third-party service providers who assist us in operating the App and delivering our services (e.g., cloud hosting, analytics, customer support). These providers are contractually obligated to keep your data confidential and use it solely for the services they provide to us.

5.2 Payment Processing

Transaction-related data is shared with PayMob, our payment gateway provider, solely for the purpose of processing your payments. We do not have access to your full payment card details.

5.3 Legal Requirements

We may disclose your personal information if required to do so by law, regulation, or a valid request from a governmental or judicial authority in the Kingdom of Saudi Arabia.

5.4 Business Transfers

In the event of a merger, acquisition, or sale of all or part of our assets, your personal data may be transferred to the acquiring entity, subject to the same privacy protections described in this policy.

6. Data Retention

We retain your personal data only for as long as necessary to provide our services and meet our legal obligations. The following outlines our specific retention periods:

  • Account & profile data: Retained while your account is active. Deleted within 30 days of account closure or after 3 years of inactivity.
  • Order & transaction data: Retained for 7 years from the transaction date (KSA VAT and commercial record obligations).
  • Location data: Deleted at the end of each session unless you have enabled location history, in which case it is retained until you disable it or close your account.
  • Customer support records: Retained for 3 years from the date of resolution (statutory limitation periods).
  • Marketing consent records: Retained for 3–6 years even after opt-out, to demonstrate compliance with consent requirements.
  • Analytics & crash data: Aggregated/anonymized after 90 days; identifiable data deleted within 90 days.

After the applicable retention period, we will securely delete or anonymize your personal data so that it can no longer be linked to you.

7. Data Security

We implement industry-standard technical and organizational security measures to protect your personal information against unauthorized access, alteration, disclosure, or destruction. These measures include encryption of data in transit, secure storage practices, and access controls limited to authorized personnel.

All data is processed and stored within secure cloud infrastructure. If any third-party service provider processes data outside the Kingdom of Saudi Arabia, we ensure appropriate contractual safeguards are in place in accordance with PDPL requirements.

However, no method of transmission over the Internet or method of electronic storage is 100% secure. While we strive to protect your personal data, we cannot guarantee its absolute security.

8. Your Rights Under the PDPL

As a user located in the Kingdom of Saudi Arabia, you have the following rights under the Personal Data Protection Law (PDPL):

  • Right of Access: You have the right to request a copy of the personal data we hold about you.
  • Right to Correction: You have the right to request correction of any inaccurate or incomplete personal data.
  • Right to Deletion: You have the right to request the deletion of your personal data, subject to applicable legal obligations.
  • Right to Withdraw Consent: Where processing is based on your consent, you may withdraw it at any time. To opt out of marketing communications, see Section 3.1.
  • Right to Data Portability: You have the right to request that your data be provided in a structured, commonly used format.

We may update this Privacy Policy from time to time to reflect changes in our practices, technology, or applicable laws. When we make material changes, we will notify you through the App or via email. The updated policy will take effect from the date indicated at the top of this document. We encourage you to review this policy periodically.
